Wage and Hour Sample Leads
Benjamin Jones is 37 years old and he is an employee at the Commodities Natural Market in New York. He was employed at the market from July 2007 until August 2009. There were about 20 other employees working at the time of his employment. His job duties included stocking produce and maintenance of the store. Benjamin worked anywhere from 40-66 hours a week and when he worked over 40 hours a week the overtime hours was paid in cash. For instance, he was always paid for 32-35 hours via check and he was paid the remaining hours in cash. He has stated that all the employees are paid the same and due to him not being paid properly his income tax and unemployment benefits have been affected. Benjamin would like to speak with an Attorney.
Reca is 24 years old and she started worked at Popeye's Chicken from March 2009 to the time of termination in July 2009. Reca worked from 10 a.m. to 5 p.m. but daily she was ordered to clock out at 5 p.m. and then she had to spend 1 hour washing dishes. Reca also informed me that she doesn't remember having breaks while working her shift. Her job title was a cashier and she worked an estimate of 40-45 hours per week. She received $6.50 an hour which is well below minimum wage. In mid July 2009 Reca was fired for unexplained reasons. Reca is interested in speaking to an Attorney in regards to this matter.
Cindy is 53 years old and she is a truck driver for FedEx. She has been an employee at FedEx since 2001 which is located in Buffalo, New York. Cindy works an average of 30-40 hours a week depending on how busy the company. Even though Cindy works 30-40 hours a week she only gets paid for 28 hours of work. At times Cindy is forced to clock out when there is no work to be done but is still working because she is responsible for the contents of the truck. If she wanted to leave it would not be possible even though she is clocked out. Cindy works with about 90 others that are forced to do the same. She has not been paid for the 5-6 hour days as long as she has been an employee at FedEx. She would like to be speak with an attorney and the best time to call is during the day.
In August of 2009 the Moonlight Diner hired Charles as a part time employee. His job description included serving food, re-stocking products, and cleaning restaurant. He worked from August of 2009 to September of 2009 for a estimate of 25 hours a week. Also, management led him to believe he was in orientation for the duration of his time spent working for Moonlight Diner. Originally, Charles believe he was in orientation for a week but he was told by management payment could not be contributed due to a probation period. Additionally, before he started working at Moonlight Diner management failed to inform him that is was in an orientation period of four weeks without payment. Charles is 20 years old and he was not compensated for his labor or time. He would like to speak with an attorney and he will provide any information needed.
Viridiane was 20 years old in 2009 when she began working for GP Communication located in Oxnard, California. The company is a mobile phone store with about three employees. She was hired as a store clerk with a hourly rate of $9.00 and she gets paid bi-weekly. Her and a another employee has been working consistently for 48 hrs a week for the last four to five months and she has not been paid for any overtime. The last seven months she has been doing duties of a supervisor with the title and pay of a clerk. She regularly makes bank drops, post office runs, office depot pick-ups and she is called in on her days off. When its time for her to run the errands she is told to clock out and to clock back in once she returns. Whenever she or other employees question the superiors they are intimidate into submission. Flagger Force is a traffic control company that has been around for about ten years. Currently, Flagger Force has an estimated 150-300 employees working as Flaggers and Senior Flaggers. The job description for the Flaggers is to maintain a safe environment in an active work zone for pedestrians and workers. Flaggers at the Flagger Force Company feel over worked and under paid due to the lack of compensation for equipment, travel time, and labor. In fact, Flaggers have to pay for maps, GPS systems, and weather gear that is only reimbursed in small percentages of money spent for the essential items. Also, Flaggers are not paid to travel from one job to another. For instance if a Flagger works with company A from 6:00am to 12:00pm and then travels 2 hours to company B to work from 2:00pm to 8:00pm he\she is not compensated for any of the travel time. Additionally, Flaggers that have been promoted to Senior Flagger do not get a pay raise and the duties increase such as setting up work zones and doing safety checks at numerous work sights. Senior Flaggers do get a company vehicle with paid gas. If you compare Union Flaggers to Flagger Force Flaggers then you would see that Union Flaggers make almost make five dollars a hour more than Flagger Force Flaggers and they have less duties.
Horace is an employee of Wal-Mart located in East Meadow, NY from 2007 until now. He is 32 years of age and his job title is Assistant supervisor. His duties include sales associate, unloading the trucks and inventory. He gets paid on an hourly wage and he has not been paid for his overtime. For an example, if Horace worked 45 hours he would not be paid for the 5 extra hrs. He asked his manager about not being paid for overtime and the managers' response was "We have a certain amount of hours to give out and he can give them out to whom he chooses". Horace also stated that he has not been paid for sick days, although he is required 3 sick days. For an example, if you were absent from work for three days due to you being sick. Instead of paying for the full 3 days, he would only be paid for 1 day of work equal to 8hrs. There is also no time in a half or bonuses for hours worked during the holiday. Horace believes that he was not paid for hundreds of hours. His employer has about 200 workers and majority of them feel cheated. He would like to speak to an Attorney in regards to possible compensation.
Joseph is 26 and has worked at J &G Drywall and Installation in Carnegie PA for five years. He is a laborer and a truck driver and works 40-50 hours a week at $10.00 an hour. He is not always paid for overtime and Joseph does not clock in and out. Joseph does not have scheduled breaks which requires him to have 5-10 minutes for eating on a 12 hour shift. He was laid off six months ago and for lack of work. Joseph now has to appeal for Unemployment Compensation benefits because of J & G saying that he quit rather than being laid off. He is interested in speaking to an Attorney in regards to this matter.
Lindsey is 57 years old and she has been working for the Yellow Tax Cab Company in Fresno, California for ten years. She works as a dispatcher and she works with eight other employees. All of them are being paid under the table and the pay rate starts at fifty dollar for an eight hour or more shift. Employees don't receive lunch breaks because they work through them. A former employee of the company had previously sued the boss for the not being paid correctly. Paulette would like to speak with an Attorney.
Sherry worked from March 12, 2002 to July 26, 2006 at the Aaron's Sales & Lease Company located in Meridian, Mississippi. During her employment at the ASL Company she suffered from unpaid overtime wages, management wages, manipulation of time cards and harassment. The shift manager would automatically clock her out at the end of her eight hour shift even if she continued working to finish incomplete duties. Additionally, she got promoted in 2004 to a manager with a pay increase of $3.50 but when she got sick in May of 2006 the ASL Company demoted her with a decrease in pay of $1.00. Being as though she was required to still complete manager duties the company should not have decrease her hourly rate. Also, she felt threatened by management to comply with unfair work ethnics because she felt threatened for the security of her job. Management would say if all duties aren't complete before the shift is over job termination will be the consequences but management was aware 8 hours was insufficient time to complete task. Sherry is 37 years old and she worked 45-60 a week not receiving any overtime pay. Aaron's Sales & Lease has about 20 employees in each store location and they have different store locations all over the USA. She would like to speak with an Attorney.
